Wenn sowohl Original als auch Importe rabattiert sind: Muss ein rabattierter Import vorrangig abgegeben werden?</b></p> <p>Nein. Stehen mehrere Rabattarzneimittel (z. B. Original und Importe) zur Auswahl, darf die Apotheke gemäß § 4 Abs. 2 Rahmenvertrag<sup>1</sup> unter diesen frei wählen. </p> <p><b>2. Ist bei der Auswahl des Rabattarzneimittels relevant, ob ein Import oder das Original verordnet wurde?</b></p> <p>Nein, wichtig ist nur, dass – unabhängig davon, ob ein Import oder das Original verordnet wurde – eines der Rabattarzneimittel abgegeben wird. Die Apotheke ist verpflichtet, Rabattvertragsarzneimittel vorrangig abzugeben. </p> <p><b>3. Wird die Importquote belastet, wenn das rabattierte Original abgegeben wird?</b></p> <p>Nein, da Rabattarzneimittel gemäß § 5 Abs. 3 Rahmenvertrag<sup>1</sup> nicht in die Berechnung der Importquote einbezogen werden. Entsprechende Rezepte gehen nicht in den relevanten Fertigarzneimittelumsatz ein. Im umgekehrten Fall wird die Abgabe eines rabattierten Imports auch nicht der Importquote angerechnet. </p> <p><b>4. Was ist bei Original-/Importverordnungen mit Aut-idem-Kreuz zu beachten?</b></p> <p>Ein Aut-idem-Kreuz allein verhindert nicht den Austausch von Original und Importen. Ein rabattiertes Original- bzw. Importarzneimittel muss demnach auch bei gesetztem Aut-idem-Kreuz vorrangig abgegeben werden. Einen entsprechenden Austausch kann der Arzt nur ausschließen, indem er zusätzlich zum Kreuz auf dem Rezept vermerkt, dass medizinisch-therapeutische Gründe dem Austausch entgegenstehen (gilt für Ersatzkassen, vgl. § 4 Abs. 12 vdek-AVV<sup>2</sup>).
