Dies gilt auch dann, wenn bei patentgeschützten Arzneimitteln wie ABILIFY Maintena<sup style="line-height:0;">®</sup> nur die Auswahl zwischen Original und Importen besteht. Liegt beispielsweise bei einer Krankenkasse ein Rabattvertrag für das Original vor, so ist das rabattierte Präparat vorrangig abzugeben. </p> <h3 style="font-family:Helvetica,Arial,sans-serif;font-size: 14px;color:#005CA9;margin-top:10px;margin-bottom:12px;"> Abgabe ohne Rabattverträge nach § 13 Rahmenvertrag </h3> <p> Sofern keine Rabattverträge die Abgabe beeinflussen, ist § 13 Rahmenvertrag für die Abgabeentscheidung maßgeblich. Demnach kann die Apotheke zwischen Original und Importen auswählen. Dabei darf das abgegebene Präparat nicht teurer sein als das verordnete (sogenannter Preisanker). </p> <p> Allerdings beeinflusst das Einsparziel die Abgabe: Die Apotheke muss dieses durch die Abgabe preisgünstiger Importe pro Krankenkasse und pro Quartal erfüllen. Die Entscheidung, mit welchen Rezepten das Einsparziel erfüllt wird, liegt jedoch bei der Apotheke – hier hat die Apotheke also Spielraum, den Patienten mit einem verordneten ABILIFY Maintena<sup style="line-height:0;">®</sup>-Original zu versorgen.
