So heißt es in der zugehörigen Beschlussempfehlung des Ausschusses für Gesundheit: </p> <div class="box" style="border:1px solid #d9d9d9; padding:4px; margin-bottom:15px; color: #555555;"> <i>„Von der Verpflichtung zur Abgabe preisgünstiger importierter Arzneimittel ausgenommen werden biotechnologisch hergestellte Arzneimittel […] wegen ihrer besonderen Anforderungen insbesondere an die Lagerung und den Transport. Die Qualität und Wirksamkeit dieser Arzneimittel wird aufgrund höherer Transportrisiken bei langen Lieferwegen als gefährdet angesehen.“</i><sup style="line-height:0;">2</sup> </div> <p> Um dieser Sichtweise des Gesetzgebers Nachdruck zu verleihen, ist der Rahmenvertrag über die Arzneimittelversorgung Mitte Dezember 2019 und mit Wirkung zum 1. Januar 2020 geändert worden.<sup style="line-height:0;">3</sup> Die Biologika sind folgerichtig in der Neufassung des Rahmenvertrages vom importrelevanten Markt ausgeschlossen worden. </p> <h3 style="font-family:Helvetica,Arial,sans-serif;font-size: 14px;color:#005CA9;margin-top:10px;margin-bottom:10px;"> Keine vorrangige Abgabe mehr von Parallelimporten zu Biologika </h3> <p> Daraus folgt zwingend, dass die Apotheke durch die Abgabe von Parallelimporten zu Biologika nicht ihr Einsparziel von 2 % im importrelevanten Markt erreichen kann. In dieser Hinsicht ist der Austausch eines rezeptierten Biologikums eines Originalherstellers gegen dasjenige eines Parallelimporteurs also ohne Vorteil für das Einsparziel. </p> <p> Bei der Bedienung von Biologika-Verordnungen (z. B.
