Der Anspruch für Versicherte ist in § 31 Abs. 3 Satz 7 SGB V definiert. Für die neue Verordnung fällt für Versicherte keine Zuzahlung mehr an und sie fällt auch bei der Wirtschaftlichkeitsprüfung der Arztpraxen nicht ins Gewicht, da sie als Praxisbesonderheit gilt. Die Ersatzverordnung muss von ärztlicher Seite mit dem Hinweis „Ersatzverordnung gem. § 31 Abs. 3 Satz 7 SGB V“ gekennzeichnet werden. Da diese fehlerhaft abgerechneten Rezepte bei den Krankenkassen zu erheblichen Problemen führen, empfiehlt der Deutsche Apothekerverband e.V.
